These Terms and Conditions (“Terms”) govern the use of the website www.merman.fr (the “Site”) and all sales or services offered by Galerie Merman. The Site is operated by GALERIE MERMAN, société immatriculée au R.C.S. de Paris sous le numéro 938 343 068, 229 Rue Saint-Honoré, 75001 Paris, France. Contact: info@merman.fr. By accessing the Site or purchasing any artwork through Galerie Merman, you agree to be bound by these Terms.
2. Scope of Application
These Terms apply to all users of the Site and to all orders and sales of artworks or other items offered by Galerie Merman, whether completed directly on the Site or following communication by email or other means initiated through the Site. Galerie Merman reserves the right to modify these Terms at any time. The version applicable at the time of the order or use of the Site shall apply.
3. Description of Artworks and Products
Galerie Merman presents original artworks created by contemporary artists. Each artwork is unique or part of a limited edition and is described as accurately as possible on the Site. However, slight variations in color, materials, or dimensions may occur depending on the medium of display (screen, lighting, etc.). Galerie Merman cannot guarantee that the colors displayed on your device precisely match the actual artwork.
4. Prices
All prices are listed in euros (€) and include applicable taxes unless otherwise stated. Prices may change at any time before an order is confirmed. Shipping, framing, insurance, and handling costs are not included in the listed prices unless expressly specified.
5. Orders and Payment
Orders are confirmed only once Galerie Merman acknowledges receipt of payment or written confirmation from the buyer. Payments are processed securely via our payment partners (e.g. Stripe, PayPal, or direct bank transfer). Galerie Merman does not store or have access to your payment card details. The gallery reserves the right to refuse or cancel any order in case of non-payment, suspicion of fraud, or other legitimate reason.
6. Delivery and Collection
Delivery methods and costs are determined individually for each sale and communicated in writing before payment. The buyer is responsible for any customs duties, taxes, or import fees applicable in their country. Risk of loss or damage passes to the buyer upon delivery of the artwork to the carrier. Buyers may also choose to collect artworks in person, by prior appointment, at Galerie Merman in Paris or another agreed location.
7. Returns and Right of Withdrawal
In accordance with European consumer protection law, buyers who are private individuals and purchase artworks online have the right to withdraw from the purchase within 14 days of receiving the work, without giving any reason. To exercise this right, please notify us in writing at info@merman.fr before the withdrawal period expires. The artwork must be returned in its original condition and packaging, at the buyer’s expense. Once the returned work is received and verified, the purchase price (excluding shipping) will be refunded. Exceptions: The right of withdrawal does not apply to custom-made or personalized works.
8. Liability
Galerie Merman strives to ensure the accuracy of all information on the Site but does not guarantee that it will be error-free or uninterrupted. We are not responsible for technical issues or temporary unavailability of the Site, indirect or consequential losses, or inaccuracies arising from information provided by artists or third parties. In no case shall Galerie Merman’s total liability exceed the price of the artwork purchased.
9. Intellectual Property
All texts, images, artworks, and other materials displayed on the Site are protected by copyright and related rights. They remain the property of the artists or Galerie Merman and may not be reproduced, distributed, or used in any form without prior written authorization.
10. Personal Data
Galerie Merman processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable French law. For more information, please refer to our Privacy Policy below.
11. Applicable Law and Jurisdiction
These Terms are governed by French law. Any dispute arising from the interpretation or execution of these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France.
